The present General Terms and Conditions have the intention of regulate the relationship between MARNYS –Martinez Nieto, S.A. (Hereunder “MARNYS”) and you (hereunder “client”), related to underlying transactions through the web www.marnys.com (hereunder “the web”), internet domain which is the owner Martinez Nieto, S.A.- legally set company, which is set in Pol. Ind. Los Camachos Sur – Av. Del Carbono, nº 96, 30369-Los Camachos / Cartagena (SPAIN), with CIF A30603757 and registration in the Commercial Registry of Murcia, in the 16 book, 3ª section, 31 sheet, piece of paper 266.

On-line products hiring and / or offered services by MARNYS through the present web shall be subject to the Generals Conditions of recruitment.
The order implies the acceptance of the general sells conditions.
2. PRICES AND PRODUCTS
The sales prices of the on-line products in the page Marnys.com, are indicated in euros, the prices will be the one which appear in force in the moment of the order.
The price of the products will be which in the web appear at the moment in which your order will be effective. MARNYS it reserved the right of modify in any moment the prices of its products, in that case the new prices will be apply immediately to the new order that you order, and any modification that you request related to any old order, which mean that any prices changes won’t be apply to the old orders done it for you that will be in progress.
Indirect taxes are included in the updates prices in the date of the order, but not the shipping cost. The shipping cost will be charged to the user and added to the total quantity of the chosen products. You will inform before you pay and complete the recruitment process.

3. THE ORDER
All orders imply the full acceptance of the restrictions and the present general sales conditions.
All order done with a pay online doesn’t take into account until validation of the banking institution, through payment server belong.
MARNYS will inform you through mail about your shipment status.

4. SHIPMENT ACCEPTANCE

6. THE PAYMENT
The payment have to be done just when the purchase has completed by the client. At any time, the amounts paid never can take into an account as a promissory note or payment of account. For paying your purchase, the client has several options:

MARNYS acept VISA and MASTER CARD.
Choosing the way of secure payment, the client will be directed at secure payment web of the Redsys Company which integrate the SSL safety standards.
The confidential payment information details are transmitted directly and encrypted form to the relevant bank and in any case are storage in MARNYS.
The payment with foreign cards can be limited depend on which country is from; you can contact with us if when you are paying receive a massage of mistake or cancelation.
Paypal / Paypal:
The client, when “confirm order”, will be returned to PAYPAL web. There you will identify or registry and you can make the payment a safety and instantaneous way. When the client has made the payment, push in “return to the merchant” and you will receive a confirmation of your payment. Cash on delivery (only available in spanish territory):
The payment cash on delivery allow you pay your order when you receive it at home: you can validate your order in our web choosing the way of payment “cash on delivery” and pay to the driver.
In favor of “Martinez Nieto, S.A.” the transference should be done in within 7 calendar days’ maximum since you did the order; in the case you have not received confirmation of the transference on time, the order will be cancel. All bank details will show you on completed the order. Be sure to mention the reference of the order in the concept.
7. FIGHT AGAINT OF FRAUD IN CREDIT CARD
The appearance of an outstanding because of fraudulent used of credit card, will do that all your information related with this order will keep it in the incidents database of the payment done by REDSYS.
Any irregularity or anomaly can be received a specific treatment.
MARNYS can check all personal details given by the client and apply the necessary measures (reclaiming the proof or the cancellation of the order) in case anomalies are detected or received any denunciation from other people.
MARNYS include 3D Secure payment system (so-called Verified by VISA/Mastercard)
Once you have filled the information of your VISA or MASTERCARD, you will be returned to your web bank where it will be asked your identification.

8. THE DELIVERY
The invoice will be sent to the client together with the order.

MARNYS products are sold and delivered in the Spanish territory:
Delivery to UPS Access Point
We can send your order to UPS Access Point (the old Kiala) to the closest point to your residence and the point that was chosen by you. You can pick up your order, when it suits, within 15 days since
Free delivery is for a purchase more than € 20.00. The delivery costs for purchases less than € 20.00 are € 3.00.
Your order will be delivered at the shop within 24/48 hrs.
Pick up your package, whenever it suits you Exchange and Returns:
The delivery of your order will be done by an external transport company, not by MARNYS (SEUR or MRW). The costs for home delivery is € 4.00/ free of charge for orders starting at € 60.00, and the delivery time is 24/48 hours.
The carrier will provide two delivery attempts. In case of the absence of the recipient, the client or addressee will receive a delivery note in the mailbox, with all necessary information required for picking up the ordered products.
We do not delivery orders to PO boxes. Except under special circumstances, we do not send orders through the public post service.
If you wish to receive the shipment at other address, you may mention this during the purchase process.
Delivery OUTSIDE SPANISH TERRITORY
MARNYS products are sold and delivered in all countries outside the Spanish territory, in the European Union as well as outside the European Union, except the following countries:
- Saudí Arabia, Kuwait, Russia, Turkey
You can choose one of the two options, depending on the availability in your country:
- Express delivery with UPS (available for all countries): the shipments will be delivered within 2-3 business days, for urgent orders.
- Traditional ground shipping (available for EU countries): the shipments will be delivered within 3-7 business days, for traditional ground shipping.
In the case that the client is present at the address within the delivery time, the delivery time mentioned will be valid. The products are deemed delivered on the date, which MARNYS mentioned as expected delivery timey.
Customs Information (Non EU Member Countries)
If your address is not in the European Union, you might be subject to the payment of customs expenses and additional taxes that are generated once the products arrive at the country of the final destination.
Any additional expenses due to the customs rights and/or customs duties will be charged by the client. We do not have any control on these expenses and we cannot predict the amount or type of these expenses.
The customs policies have changed from one country to another, therefore you should contact with your customs for more information. Remember, besides, that when we place an order in Marnys.com, you are considered as an importer of the shipment and must comply with laws and appliance rules in the receiver country. Usually, customs models are organized depend on the type of order.
MARNYS has not received any return shipment that cannot be delivered for customs reasons. The shipments keep them in Customs office and no possibility to delivery for reasons beyond MARNYS reason, shall be declared in abandoned, without any possibility to total or partial payment return.
Your privacy is very important for us and we know that you are worry the way in which we use your shipment information. Notwithstanding, we would like to inform you that international business is subject to inspections and revisions by customs authorities from each country. Maybe we have to provide some information about the product to our transportation agent. Likewise, it is possible that our information should be given to the authorities for legal compliance.
In order to avoid any problem with customs office in the import, we suggest you to contact with customs office and find out, before you place an order, about all import restrictions in your country.
Rights of withdrawal and refund
In compliance with current law, the customer has 14 calendars day since you receive the order, for exercising the right of withdrawal about the order; that means, you can cancel the order without any reason.
The right to appeal to right of withdrawal, you should notify in writing to us (MARNYS – Martinez Nieto, S.A. – Poligono Industrial Los Camachos Sur – Av. You can use the model withdrawal form that you can find here below, although it uses it is not obligatory.
In case of withdrawal from your side, we will return all payment done it from your side, included all delivery expenses.
For all orders delivered in Spain, the return is always free. MARNYS will pay all the expenses of the return order. MARNYS will send to your address a mail service for returning the shipment.

You have to send us the shipment n good conditions, without using and in its original package. It is very important you return the shipment in the original package.
The refund of the order will be done on arrival to Martinez Nieto, S.A. office, and after check the shipment.
We will use the same way that you used for pay the order (except cash on delivery) unless you have ordered the opposite, in that case, you do not have any cost.
Take into account that the payment will show you the following month for your bank.
If you pay cash on delivery, once we will have received the shipment we will refund to you by bank transference in the number of account that you give it to us. You should give us the bank number by mail.
Refunds with defective ítem or are not agree with the order.
In this change process, we advise you to add a photo of the product unpackaged in which we can notice the damage or defect. Once we have checked the information from the custom, we will deliver the same product requested by the custom and ratify the new order. In this case, you do not have to pay the delivery cost. The cost will pay by MARNYS.
11. COMPETENT JURISDICTION
The present sells condition will be based on the Spanish law. The contract will understand in the place you have your habitual residence; you should know the law sell condition and court of it place.
